Terms and conditions of purchase September 2014

These terms and conditions of purchase apply to goods purchased on bluehorscare.com ("Website/The Website"), owned by Blue Hors ApS, Central Business Register no. 15 50 47 49, Tørskindvej 70, DK-7183 Randbøl, Denmark (hereafter called "Bluehorscare"). These terms and conditions of purchase apply only to consumers and not to business enterprises.
These terms and conditions are Bluehorscare’s standard conditions. They are available online and can be seen by the consumers. They shall be binding upon consumers who acknowledge, while checking the corresponding box, that they have read and accepted the terms and conditions before ordering online. By ordering a product on the site, the consumer expressly agrees to these terms and conditions, as they are in force on the date of the order.
1. How to trade with us

You can order goods on our Website.
 
To make a purchase on The Website you will be required to follow these five steps:
1. Find the items you wish to order, place them in the shopping basket and then proceed to the checkout.
2. Enter your personal information (which we will process in accordance with item 10 below once your order is complete).
3. Choose delivery and payment method.
4. Read and confirm you agree with our terms and conditions of purchase.
5. Check that all of the information is correct on the summary page and then approve the order.
 
The sale offers online are available as long as the product is visible on The Website, and are valid within the limits of available stocks.
2. Order confirmation and receipt

You are able to change the information that you have provided, including delivery and invoice information, before you place your order. Furthermore, you are able to change or remove the goods in your shopping basket.
 
Your purchase order becomes valid when you confirm the order by clicking "accept and pay" and you will subsequently receive a confirmation of your order via email including these terms and conditions.
 
The email will confirm that Bluehorscare has received your order and it is also your receipt of purchase.
 
The total price is stated on the order confirmation, i.e. it includes the price of the goods, VAT, other costs/charges and delivery costs.
3. Price policy

All prices stated on The Webpage are in Euros and include VAT and other charges, except for delivery charges.
Our prices may change at any time, but price changes will not affect orders that you have already placed.

 
4. Payment

When you make purchases on The Webpage, you must use a debit or credit card.
The Webpage accepts the following debit/credit cards: Dankort, VISA-Dankort, MasterCard, Maestro, Visa, Visa Electron and JCB.
Before you make your payment, you will be shown the credit card fee for each card type. When you choose a card, the whole amount that will be debited from your account is shown. The debit transaction will be made when we have dispatched your goods.
5. Delivery

Goods purchased on The Webpage are delivered by Post Danmark or GLS.
 
For delivery destinations in Denmark, orders will take 1-3 working days to arrive, depending on the goods ordered and availability of stock.
For delivery destinations outside of Denmark, orders will normally take 3–10 working days to arrive. However, please contact us for more detailed information about delivery times.
 
If bluehorscare.com is unable to deliver your order within 30 calendar days from the order being placed, you are entitled to cancel the purchase agreement.
 
The goods will be at your risk from the time of delivery.
6. Right to withdraw

When you make a purchase order on The Webpage you have the right to withdraw from your purchase order within 14 calendar days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
 
In the case of a purchase order relating to multiple goods ordered by you in one order and delivered separately, the withdrawal period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
 
To exercise your right to cancel, you must explicitly inform us that you have decided to withdraw from your purchase (e.g. by letter, fax or email) to Blue Hors Care, Tørskindvej 70, Lihmskov DK-7183 Randbøl, Denmark, Tel.:+45 +45 75 88 39 11, E-mail: support@bluehors.dk. You can also use our cancellation form, which is available on our website www.bluehorscare.com.
You will also find the cancellation form at the end of these terms and conditions.
If you use our cancellation form or if you otherwise inform us that you wish to use your cancellation right, you will - without undue delay - receive email confirmation from us that we have received your cancellation.
Your cancellation is valid as long as you send your cancellation before the cancellation period (14 calendar days) has expired.
Effects of withdrawal

If you exercise your right to withdraw, we will refund your money, including delivery costs (however, not extra costs that result from your own choice of delivery should it be other than the cheapest form of standard delivery that we offer), without undue delay and not later than 14 calendar days at the latest from the day we have received your decision to cancel your purchase order.
 
We will reimburse your money using the same method of payment that you used with the original transaction unless you have expressly consented to another method of reimbursement. Under no circumstances will you have to pay any form of charge as a consequence of reimbursement.
 
We may withhold reimbursement until the goods have been returned or you have submitted documentation showing the goods have been returned, whichever is quickest.
 
You have to return the goods to us without undue delay and no later than 14 calendar days after the day where you informed us about your use of your right to cancel.

You have met the deadline if you return the goods before the expiry of the 14 days' period.

You must pay any direct costs related to the return of the goods.

If the value of the goods has diminished as a result of your handling of the goods beyond what is necessary to determine their nature, properties and the way they work, you shall be liable for this amount, up to the contract price
 
7. Non-conformity of the goods

In accordance with the Danish Sale of Goods Act, the warranty of conformity for goods is valid for two years for all goods.
 
The warranty means that you as the customer may make a complaint regarding defects or faults in the product that have occurred within two years of when you took possession of the good. However, this is conditional on the defects or faults not having been the result of your own harmful conduct.

You must complain within a reasonable time after you discovered the defect or fault. In accordance with the warranty, you may be able to have the goods repaired, exchanged or have your money refunded or be given a price reduction, all depending on the specific situation.
In connection with the warranty, Bluehorscare covers the costs of returning the goods to a reasonable extent.
We cannot be held responsible for minor differences in the product compared to the images on The Webpage since the manufacturers may make ongoing alterations.

8. Refunds

In the case of refunds, we will refund your money, including delivery costs (however, not extra costs that result from your own choice of delivery should it be other than the cheapest form of standard delivery that we offer), without unnecessary delay and in all circumstances 14 calendar days at the latest from the day we have received your decision to cancel your purchase order, terminate the purchase order, etc.
We will reimburse your money using the same method of payment that you used with the original transaction unless you have expressly consented to another method of reimbursement. Under no circumstances will you have to pay any form of charge as a consequence of reimbursement.
 
We may withhold reimbursement until the goods have been returned or you have submitted documentation proving the goods have been returned, whichever is the quickest.

When exercising your right of withdrawal or your warranty, including inquiries about absent deliveries, complaints etc., use the following address:

The return of goods may also occur by refusing to receive the goods or by personally delivering the goods to the above address.

Please note that we do not accept packages sent cash on delivery or collect packages sent to the postal offices/collection points.

 
10. Complaints

You can lodge a complaint with the Danish Consumer Complaints Board if you are not satisfied with the goods you have received and are unable to come to an amicable agreement with Bluehorstotalpleje. 11. Personal data

When placing a purchase order on The Webpage you must provide your name, address, e-mail address and telephone number. At all times, personal data that is registered by Bluehorscare is treated in accordance with the applicable regulations regarding the processing of personal data.

13. Jurisdiction and Venue

The purchase order is subject to Danish law. Any dispute will be subject to the non-exclusive jurisdiction of the Danish courts. As you are contracting as a consumer, nothing in this item 12 will affect your statutory rights as such.
